This Privacy Policy (“Policy”) describes how The Comfort Specialists, LLC (“Company,” “we,” “us,” or “our”), a Massachusetts limited liability company with its principal place of business in Clinton, Massachusetts, collects, uses, and shares information from Users of our website (the “Site”) and Services. This Policy applies to all Users—Guests, Customers, and Members—as defined in our Terms of Service. The Company’s data practices are designed to comply with Massachusetts data privacy and security requirements, including obligations relating to the protection of personal information of Commonwealth residents.

Information Collected from Guests

We automatically collect: IP address; browser type and version; operating system; referring URLs; pages viewed; date and time of visit; and other server log data. We also collect information through cookies and similar technologies as described in Section 6.

Information Collected from Customers

In addition to the above, we collect: name; email address; mailing address; telephone number; payment and billing information (credit card, debit card, or bank account details); purchase and transaction history; service records; property address (if different from mailing address); equipment and system information relating to services performed; photographs of completed work; and communications with us.

Information Collected from Members

In addition to the above, we collect: membership tier selection and enrollment date; subscription billing information and payment method on file; benefit usage history (including Loyalty Fund accrual and redemption); priority service scheduling records; multi-system add-on selections; and membership-related preferences and communications.

Information from Third Parties

We may receive information from third-party sources such as payment processors, marketing partners, and analytics providers, and may combine it with information collected directly from you.

How We Use Your Information

All Users: To operate and improve the Site; monitor usage; detect and prevent fraud and security issues; comply with applicable law; and enforce our Terms of Service.

Customers and Members: To process transactions; manage accounts; provide customer support; send administrative and promotional communications (subject to your preferences); personalize your experience; process rebate applications and coordinate with third-party rebate administrators (such as Mass Save); and maintain photographs of completed work for quality assurance and marketing purposes.

Members: To administer the Membership Program, including processing monthly fees, managing tier-specific benefits and discounts, tracking Loyalty Fund accrual and usage, coordinating priority service scheduling, and providing exclusive offers and content.

How We Share Your Information

We do not sell your personal information. We may share information as follows:

Service Providers. With vendors who perform services on our behalf (payment processing, analytics, hosting, marketing). These providers may use your information only to provide services to us.

Legal Requirements. When required by law or valid legal process.

Protection of Rights. To investigate violations of our Terms, suspected fraud, or threats to safety, or as evidence in litigation.

Business Transfers. In connection with a merger, asset sale, financing, or acquisition.

With Your Consent. When you have given us consent to share your information.

Data Retention

We retain personal information as long as necessary to fulfill the purposes for which it was collected and to satisfy legal, accounting, or reporting requirements.

Guests: Automatically collected data is retained for up to [insert time period, e.g., twelve (12) months] unless a longer period is required by law.

Customers: Account and transaction information is retained while your account is active and for a reasonable period thereafter, consistent with applicable Massachusetts record-retention obligations.

Members: Member information is retained for the duration of membership and a reasonable period after cancellation. Post-membership retention follows the Customer policy above.

Children's Privacy

The Site is not directed to individuals under eighteen (18), and we do not knowingly collect personal information from children. If we learn we have collected such information without parental consent, we will promptly delete it. Please contact us if you believe we have collected information from a minor.
